NCLAT issues notice to Boeing; hearing scheduled for December

Metro India News | new delhi : The liquidator of Jet Airways has approached the National Company Law Appellate Tribunal (NCLAT), seeking a refund of $92.13 million paid to Boeing as advances for aircraft that were never delivered. The NCLAT has issued notice to Boeing, seeking its response to the appeal against the NCLT’s September 11 order rejecting the refund claim. Boeing has been given two weeks to reply, while the liquidator may file a rejoinder within a week thereafter. The matter is scheduled for hearing in the first week of December.

The dispute relates to aircraft purchase agreements signed in 2013. Following Jet Airways’ financial crisis, Boeing terminated the agreements without delivering any aircraft. The liquidator argued that the advance payments belonged to Jet Airways’ liquidation estate and should be refunded. Boeing, however, maintained that the amounts had already been adjusted against its outstanding claim against the airline.

The NCLT had dismissed the refund application, holding that the dispute involved contractual issues requiring separate examination. The liquidator has now challenged the order before the NCLAT.
